BUDWEISER® BAND OF BUDS CONTEST OFFICIAL RULES

NO PURCHASE NECESSARY. THE FOLLOWING CONTEST IS INTENDED FOR VIEWING IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED ACCORDING TO UNITED STATES LAW.

  1. ELIGIBILITY: The “Budweiser Band of Buds Contest” (“Contest”) is open to groups of four (4) eligible participants (“Crews”) who are residents of the United States (except CA) 21 years of age or older. Employees and the immediate families of employees of Anheuser-Busch, Inc. (“Sponsor”), its affiliates and subsidiaries, employees and immediate families of employees of wholesale distributors, advertising and promotion agencies, individual retail licensees and the 2010 Budweiser Band of Buds Grand Prize winning Crew are ineligible. By participating in this Contest, participants agree to be bound by the Official Rules of this Contest.
  2. TO ENTER: During all phases of the Contest, there must be four (4) eligible individuals to a Crew. Any Crew not containing four (4) eligible individuals will not be able to participate. Participants can only join one Crew and be part of one Crew at any given time. If a Crew advances to Phase 3, the Casting Call Night, one (1) Crew member substitution will be allowed should a Crew member be unable to attend; however, if that Crew is selected as a Market Winner or Wild Card Winner, the substitute Crew member will become the registered member of the Crew and will replace the original Crew member. No other Crew member substitutions are allowed.
  3. CONTEST TIMING: The Contest is divided into three (3) Phases as defined below. See Appendix A for a list of the twenty (20) participating Markets and each Market time line.
  4. PHASE 1: Crews must register for the Contest by logging on to www.bandofbuds.com (“Website”) and follow the online instructions to build a profile page for their Crew (“Profile Page”). Online registration begins at 12:00:00 am CDT on July 2, 2011 and ends at 12:00:00 am CDT on September 15, 2011 (“Registration Period”). The Sponsor’s Website administrator’s computer is the official timekeeping device for this Contest. At the time of registration, Crews are assigned to one (1) of twenty (20) Markets based on the founding Crew Member’s zip code. For a list of eligible zip codes in each participating Market, see link on entry page on Website. See Appendix A for a list of the twenty (20) markets. The Profile Page should include information about the Crew, photo(s) of the Crew and links to video(s) of the Crew. See Website and Rule #4(c) for an outline of Profile Page tasks and photo/video Challenges, and their corresponding point values.
    1. Photos must be submitted in a jpeg format; a maximum image size of 2048 x 1536; and a maximum file size of 1 MB for each photo. Videos must be submitted in one of the following formats and a maximum file size of 5 MB for each video: AAC, AVI, 3GP, FLV, MOV, MP3, MP4, MPEG, OGG, WAV, WEBM, WMA, or WMV. There is no limit to the number of video links or photos you may reference; however, there is a limit of three (3) photos per Challenge and/or one (1) video per Challenge. See Rule #9 for additional comment, photo and video guidelines that you must adhere to. Hereinafter photos, videos and comments may be referred to as “Content”.
    2. Registered Users and Non-Registered Visitors:
      1. During the Registration Period, visitors to the Website will have the opportunity to become Registered Users by following the online instructions. Registered Users may become a “Fan” of a Crew (either at the invitation of a Crew member or on his or her own), vote for a Crew, upload comments, and vote for Content, as detailed below (collectively, “Fan Actions”). Points may be earned by Crews for each of these Fan Actions, as detailed in subsection (c)(2).
        1. “Fan” of a Crew. Registered Users may become a “Fan” of a Crew by following the online instructions. Registered Users may become a “Fan” of multiple Crews. The first Crew of which a Registered User becomes a Fan will earn 25 points. Fans will have a personal Fan page on the Website, including a profile photo and links to each Crew of which they are a Fan. Fans may upload photos of the Crews of which they are Fans, which the Crew may elect to post on its Crew page. If a visitor to the Website becomes a Registered User at the invitation of a Crew Member, the Registered User will automatically become a Fan of the Crew whose member issued the invitation.
        2. Registered Users may vote for a Crew. Each vote cast for a Crew will earn the Crew points as provided in subsection (c)(2). Registered Users may vote for more than one Crew, but may only cast one vote per Crew per day.
        3. Registered Users may post comments on the Website, subject to the Content Guidelines in paragraph 9 of these Official Rules.
        4. Registered Users may vote for Content posted by Crews on the Website. Each vote cast for Content will earn the Crew points as provided in subsection (c)(2). Registered Users may vote for multiple Content items, but may only cast one vote per Content item for the Registration Period.
      2. Visitors may also view Website Content as Non-Registered Visitors. Non-Registered Visitors may cast votes for a Crew. Votes cast by Non-Registered Visitors earn the Crew one point. Non-Registered Visitors may vote for more than one Crew, but may only cast one vote per Crew per day.
      3. A “day” is defined as a twenty-four (24) hour time period beginning at 12:00:00 a.m. CDT and ending the same day at 11:59:59 p.m. CDT with the exception of the last day which will end at 12:00:00 a.m. CDT.
      4. Any use of robotic, macro, automatic, programmed or like voting methods will void all such votes. Any attempt by a Crew member and/or his/her family/friends to affiliate him/herself or vote more than the number of times authorized herein using multiple names or email addresses and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify the Crew in its reasonable discretion.
    3. Online Voting/Earning Points:
      1. During the Registration Period, Crews can earn points by completing tasks and challenges as posted on the Website, and by accumulating votes from Registered Users and Non-Registered Visitors.
      2. Crews earn points for the activities as outlined in the chart below, and as stated on the Website. Challenges will be issued from time to time on the Website with points to be earned as specified for that challenge. Challenges that earn 50 points are classified as “Easy Level Challenges”; challenges that earn 100 points are classified as “Medium Level Challenges; and challenges that earn 200 points are classified as “Hard Level Challenges”. Crews must comply with the stated requirements of the challenge in order to earn the points. All challenge submissions will be judged by Sponsor to determine whether the challenge has been satisfied and such determinations and the awarding of points are in Sponsor’s sole discretion. For each challenge, Crews may submit up to three (3) photos and/or (1) video, but points will be awarded only once for an approved submission.

  5. SEMI-FINALIST DETERMINATION: The ten (10) Crews receiving the highest amount of points obtained from uploading Content, acquiring Crew Fans, and receiving votes and completing Challenges (as stated above) will be deemed the Semi-Finalists (“Semi-Finalists”) for their Market, for a total of two-hundred (200) Semi-Finalists, and will be invited to participate in their Market's Casting Call Night. In the event of a tie, Sponsor will determine the Semi-Finalist by judging the tied Crews based on overall Crew Creativity. There will be twenty (20) Casting Call Night events. See Appendix A for the scheduled date of each Market’s Casting Call Night. Time and location details of each Market’s Casting Call Night to be provided to Semi-Finalists at the time of notification. Semi-Finalists will be notified by phone and/or email and will be required to respond to the phone call or email within forty-eight (48) hours indicating whether Crew can compete in the Casting Call Night. If no return call is received within the time allotted, an alternate Semi-Finalist will be selected (time permitting). Any alternates selected will also be required to respond to the phone call within forty-eight (48) hours. In the event that there are fewer than ten (10) Crews in any Market, Sponsor reserves the right to proceed in this Contest with fewer than ten (10) Semi-Finalists in any given Market.
  6. PHASE 2: Semi-Finalists will be invited to their Market’s “Casting Call Night” in which Crews will compete in a series of challenges (each a “Casting Call Night’s Challenge”) to determine the Market Winner (“Market Winner”). Event details to be provided at each Casting Call Night. One (1) Market Winner will be determined by the outcome of each Casting Call Night’s Challenges from each of the twenty (20) Markets for a total of twenty (20) Market Winners. Casting Call Night’s Challenges will be judged by a panel of judges chosen by Sponsor, and the decisions of the judges are final and binding in all matters relating to this Contest. The four (4) Semi-Finalists receiving the highest amount of points awarded by the judges (“Finalists”) will advance to the final Casting Call Night’s Challenge, the Bud Wise Game. The Finalist receiving the highest amount of points in the Bud Wise Game will be deemed the Market Winner (“Market Winner”) and will advance to the Budweiser Band of Buds Final Competition in Las Vegas, Nevada. An additional five (5) Wild Card Winners (“Wild Card Winners”) will be selected from the remaining 60 Finalists by Sponsor, in Sponsor’s sole discretion. A Wild Card Winner must have participated in one of the twenty (20) Casting Call Nights, and must have been selected as a Finalist to be eligible. The Wild Card Winners will be notified on or about November 15, 2011.
  7. PHASE 3: In order for any Crew to compete in the Budweiser Band of Buds Final Competition (“Final Competition”), the four (4) eligible individual Crew members that competed and won as Market Winners in the “Casting Call Night”, or were chosen as a Wild Card Winner, must be the same four (4) eligible individuals (together the “Crew”) competing in this Final Competition. The Final Competition will be held from December 14, 2011 through December 18, 2011 in Las Vegas, Nevada. All Crew members must be present to participate in the Band of Buds Final Competition Challenges. Failure to be on time to any given Challenge or event may result in disqualification, in Sponsor’s sole discretion. Prior to each Challenge, Crews will be provided with Challenge details. Challenges will be judged by a panel of judges chosen by Sponsor, and the decisions of the judges are final and binding in all matters relating to this Contest. Contestants will be judged on their camaraderie, originality, appeal as a Budweiser Brand Ambassador, and ability to work as a team. The Band of Buds Final Competition Crew receiving the highest amount of points will be deemed the Grand Prize Winner. Challenges are at Sponsor’s sole discretion and are subject to change and modification. The Challenges may be videotaped and/or photographed. Sponsor not responsible for any inability of a Crew and/or Crew member to be present at a particular Challenge including, but not limited to, transportation delays, delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other event beyond Sponsor’s reasonable control.
  8. PARTICIPATION GUIDELINES: At no time while participating in the Contest should any Crew member:
    1. be under the influence of drugs or excess alcohol;
    2. promote drinking and driving or the excessive or irresponsible consumption of alcohol;
    3. promote the illegal use of alcohol, drugs, or violating any law;
    4. communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
    5. be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, or exploit people in a sexual or violent manner;
    6. be obscene or offensive, endorse any form of hate or hate group;
    7. otherwise fail to comply with the Beer Institute Advertising and Marketing Code as made publicly available at the following online location: http://www.beerinstitute.org/​BeerInstitute/​files/​ccLibraryFiles/​Filename/​000000000384/​2006ADCODE.pdf; or
    8. be deemed inappropriate by Sponsor, in Sponsor’s sole discretion.
    At any time during the Contest, a Budweiser representative reserves the right to disqualify any Crew, in his/her sole discretion, if he/she believes the Crew or an individual Crew member is deemed inappropriate. Sponsor, in its sole discretion, may require a Crew to change its name if the name is the same as or confusingly similar to another Crew name.
  9. CONTENT GUIDELINES: Content cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies or communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate. Sponsor shall have full right and power to copy, publish, broadcast, display, distribute, use, edit, translate, alter, combine with other material, reuse and adapt any or all portions of the Content in any way and for any purpose whatsoever, at any time, now or in the future, in any media now known or hereafter devised throughout the world in any manner whatsoever and for any purpose. Content that is not in accordance with the guidelines as stated herein or on the Website will be ineligible. Content cannot
    1. be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
    2. promote the excessive or irresponsible consumption of alcohol, or promote illegal use of alcohol, drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous or any particular political agenda or message;
    3. be obscene or offensive, endorse any form of hate or hate group;
    4. contain an image of anyone under 21 years of age;
    5. otherwise fails to comply with the Beer Institute Advertising and Marketing Code as made publicly available at the following online location: http://www.beerinstitute.org/​BeerInstitute/​files/​ccLibraryFiles/​Filename/​000000000384/​2006ADCODE.pdf;
    6. contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind (other than Budweiser), without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses or street addresses;
    7. contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in Web sites, television, movies or other media) without permission;
    8. contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission; or
    9. depict, and cannot itself be in, violation of any law.
    By submitting Content you warrant and represent that it:
    1. is your original work,
    2. has not been previously published,
    3. has not received previous awards,
    4. does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;
    5. that you have obtained permission from a person who is used in the entry or whose name or likeness is used in the Content, if any, and
    6. that publication of the Content via various media including Web posting, will not infringe on the rights of any third party rights.
    Any such entrant will indemnify and hold harmless, Sponsor from any claims to the contrary. Any entrant whose Content includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor’s use of such Content, in a form satisfactory to Sponsor, upon request, prior to award of prize and/or naming of entrant as a winner. All content is subject to Sponsor’s Digital Millennium Copyright Act policy which is available in the Terms & Conditions, section 10. Any Content that, in the sole opinion of Sponsor, is deemed to be inappropriate for publication is ineligible. Incomplete, illegible, deceptive or garbled Content are not eligible.
  10. PRIZE DETAILS:
    1. Grand Prize (1) - The Band of Buds Final Competition winning Crew will receive $100,000.00 to be split equally among the four (4) Crew members. Cash prize will be awarded in the form of a wire transfer or check, payable to each Crew Member. Approximate Retail Value (“ARV”): $100,000.00 per Crew; $25,000.00 per Crew member. In addition to the above-stated cash prize, the Band of Buds Final Competition winning Crew will receive a trip to New York City, New York to attend a photo shoot. Trip consists of round-trip coach air transportation (from gateway city nearest winner’s home); double-occupancy hotel accommodations for two (2) consecutive nights; and a meal stipend of $100.00 per person per day for two (2) days (awarded in the form of a pre-paid debit card). Travel dates to be determined by Sponsor, in Sponsor’s sole discretion, at a later date. ARV of trip portion of prize: $8,000.00; $2,000.00 per Crew member.
    2. Market Winner Prize (25 total, 1 per Market plus 5 Wild Card Winners): A trip for each Crew member of the Market Winner and Wild Card Winner to Las Vegas, NV for an opportunity to compete in the Band of Buds Final Competition. Trip consists of round-trip coach air transportation (from gateway city nearest winner’s home); double-occupancy hotel accommodations for four (4) consecutive nights; a meal stipend of $100.00 per person per day for four (4) days (awarded in the form of a pre-paid debit card); and admission to all Budweiser Band Of Buds sponsored events. Travel dates are: December 14, 2011 – December 18, 2011. ARV: $6,000.00 per Crew; $1,500.00 per Crew member.
    3. Semi-Finalist Prize (up to 800 total, 10 per Market): Semi-Finalist Crew Members traveling 40 to 250 miles to the Casting Call Night location will receive a $200.00 debit card that can be used for gas and one (1) night hotel accommodations. ARV: $125.00 per Semi-Finalist Crew Member. Total ARV if 40 to 250 miles: up to $25,000.00: Semi-Finalist Crew Member traveling more than 250 miles to the Casting Call Night location will receive round-trip coach air transportation (from gateway city nearest winner’s home) and one (1) night hotel accommodations. ARV: $300.00 per Crew Member. Total ARV if greater than 250 miles: up to $240,000.00. Mileage and hotel accommodations to be determined by Sponsor in Sponsor’s sole discretion. Semi-Finalists who reside closer than 40 miles of Casting Call Night location will travel at their own expense.
    4. For prizes including air transportation: Winner must travel on the dates specified by Sponsor or prize will be forfeited and Crew may be disqualified. Winner must comply with all travel requirements, which may include, without limitation, presenting necessary identification (including passport or driver’s license) at the time of travel. Flight schedules are subject to change without notice. Any costs incurred due to changes to the original itinerary are solely the winner’s responsibility. Actual value depends on city/day/time of departure.
    5. For prizes including a pre-paid debit card: Winner must comply with the terms and conditions as stated on the debit card.
    6. For all prizes: Travel and accommodations are at the Sponsor’s discretion and subject to availability and change. Ground transportation, meals, gratuities and all other expenses not specified herein are solely winner’s responsibility.
    7. If Crew (collectively all Crew members) cannot accept prize as specified, prize may be forfeited and awarded to an alternate Crew. The difference between any stated value and actual value will not be awarded. Total ARV of all prizes is up to $498,000.00
  11. CONDITIONS APPLICABLE TO THE OVERALL WINNING CREW OF THE BAND OF BUDS FINAL COMPETITION: By accepting the title of the overall winning Crew of the Band of Buds Final Competition, for no additional compensation or consideration, winning Crew members grant to Sponsor the right to use his/her or their names, nicknames, initials, facsimile signatures, photograph, likeness, biographical information and/or endorsement in connection with the advertisement and promotion of this Contest. Crew members will be required to participate in one (1) or more Promotional Events as reasonably requested by Sponsor. For the purpose of these Official Rules, a “Promotional Event” is any event or activity sponsored by Sponsor, including but not limited to: Interviews, whether live, taped, print, broadcast, magazine/TV/radio events; satellite media tours, video news releases, audio news releases, TV shoots (including, but not limited to participation in a reality show), recording sessions, photo sessions; event appearances and other engagements.

    If an eligible participant
    1. has been convicted of a felony or has felony charges pending against him or her;
    2. has been convicted of any crime (felony or misdemeanor) that, sponsor determines in its sole discretion, involves drugs or alcohol, domestic violence, or child endangerment or has charges of such crime pending against him or her;
    3. has an outstanding arrest warrant (felony or misdemeanor) against him or her; or
    4. is subject to a restraining order,
    he/she is not eligible to win the Contest, and his/her Crew may be disqualified, in Sponsor’s discretion.
  12. MARKET WINNER AND WILD CARD WINNER NOTIFICATION: All prizes will be awarded (time permitting). Market Winners will be announced at each Casting Call Night. Wild Card Winners will be notified on or about November 15, 2011. Winners will receive additional information via mail, email and/or text and will be required to complete, sign and return an affidavit of eligibility and liability and publicity release within seven (7) days of prize notification. In the event of noncompliance within this time period, prize will be forfeited and an alternate winner selected (time permitting). Any alternates selected will also be required to adhere to the time periods described herein. Any prize notification or prize returned to the Sponsor or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate winner. Winner may not substitute or transfer prize but Sponsor reserves the right to substitute prize with prize of equal or greater value. This Contest is void where prohibited by law and is subject to federal, state and local regulations. Taxes on prizes, if any, are solely the responsibility of the individual winners.
  13. LIMITATIONS OF LIABILITY AND RELEASE: Anheuser-Busch, Inc., its affiliates, subsidiaries, and agencies are not responsible for lost, late, misdirected, unintelligible, returned or undelivered entries, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Contest or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Website’s terms of service, as solely determined by the Sponsor, will be disqualified. Neither the Sponsor nor its agencies are responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Contest, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized Website access. Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries, votes and/or Crew Fan affiliations, and may subject that entrant to disqualification. Neither the Sponsor nor its agencies are responsible for injury or damage to participant’s or any other person’s computer or property related to or resulting from participating in this Contest. Should any portion of Contest be, in the Sponsor’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Contest, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, and select the winner(s) from valid entries received prior to action taken, or otherwise as may be deemed fair and equitable by the Sponsor. In the event of a dispute regarding entries received from multiple users having the same email, the authorized subscriber of the email account used to enter will be deemed to be the entrant, and must comply with these rules. The authorized account subscriber is the natural person who is assigned the email address by the ISP or other organization responsible for assigning email addresses. All materials submitted become the property of Sponsor and will not be returned.

    Entrants agree
    1. that Sponsor and its parent, subsidiary and affiliated companies, and advertising and promotion agencies, and their respective officers, directors, employees, wholesale distributors, representatives and agents, will have no liability whatsoever for, and are released and shall be held harmless by participants against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Contest or in any Contest-related activity, and
    2. winners, by acceptance of prize, except where legally prohibited, grant permission for Sponsor (and agree to confirm such agreement in writing) and those acting pursuant to its authority to use his/her name, photograph, likeness, voice, image, statements, biographical information, and Content (which may be altered, changed, modified, edited, used alone or with other works, as solely determined by Sponsor) for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered world wide and on the Internet and/or World Wide Web without notice or review or approval.
  14. You grant to Sponsor an exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right and license to exploit your Content in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party, including, without limitation, your Content and any person’s property (physical, personal, and indicia) contained therein. The foregoing grant includes, without limitation, the right to reproduce, alter, amend, edit, publish, use, merchandise, license, sublicense, and adapt the Content in any and all media now or hereafter known, throughout the world, for any purpose, whether commercial in nature or otherwise, including in contexts and circumstances that result in your Content being associated with a particular Sponsor or Sponsors. Accordingly, you hereby waive any objection to, such use, distribution, reproduction or display of your Content, and any claim for compensation whatsoever in connection therewith. Such waiver shall include any claim for infringement of any so-called “Moral Right,” “Droit Moral” or similar right or interest.
